Terms of Service
Last updated October 26, 2026
These Terms of Service (the “Terms”) are an agreement between you and Lone Keem Studios (“Lone Keem Studios”, “Kemy”, “we”, “us” or “our”), the independent studio that runs Kemy. They cover the Kemy website at lonekeem.github.io, the Kemy Android app on Google Play, and every feature in them, including accounts, posts, comments, stars (likes), saves, follows, live streams, Kemy Pals, Kemy Street houses, Pal Park, games, movies, series, music, lyrics, filters and notes to the Kemy team (together, the “Service”).
The short version
This summary is here to help you read the Terms. It is not a replacement for them. If anything here seems different from the full Terms below, the full Terms apply.
- Kemy is free. There are no ads and nothing to buy with real money in the app today. Star Coins and Diamonds are free in-app points with no cash value.
- Ages. Players under 13 get strict safety limits and need a parent or guardian’s permission. Players under 18 need a parent or guardian to agree to these Terms for them.
- Your posts are yours. You keep ownership. You give us a license to host and show them so Kemy can work, and you promise you have the right to post them.
- Age ratings are your job. If you mark a post 13+ or 17+, rate it honestly. The Community Guidelines still apply to every post, at every rating.
- Be kind and stay safe. No nudity, sexual content, real gore, hate, bullying, scams, stolen content or anything illegal. Never meet people from Kemy in person.
- We can remove content or accounts that break the rules, and Kemy may change or stop features.
- Kemy is provided “as is”. Our responsibility to you is limited, as explained below.
- Disputes go to individual arbitration, not class actions or jury trials, unless you opt out within 30 days. Small-claims court is still available. Maine law applies.
1. Agreeing to these Terms
By creating an account, checking the agreement box when you sign up, posting, or otherwise using the Service, you agree to these Terms, the Community Guidelines, and the in-app Community Rules. Our Privacy Policy and our Kids safety and parents page explain how information is handled and which safety limits are on. Please read them too. If you do not agree to these Terms, do not use the Service.
The Community Guidelines and Community Rules are part of these Terms. Some features may show extra rules when you use them (for example, a game, a live stream, or uploading a movie). Those rules are also part of these Terms.
2. Who can use Kemy
- Your birthday. Kemy asks for your birth month and year when you sign up. Enter it honestly. It is typed by you. It is not an ID check and not a parent-consent form. Once saved, it can only be changed by Kemy’s staff, so ask through Message the Kemy team if it was entered wrong.
- 13 and older. Players 13 and older can post, comment, upload, go live and use filtered public chat, as long as they follow these Terms.
- Under 18. If you are under 18 (or under the age of majority where you live), you may use Kemy only with the permission of a parent or legal guardian, who must read and agree to these Terms for you. A parent or guardian who allows a minor to use Kemy is responsible for that minor’s use of the Service.
- Under 13. Children under 13 may use Kemy only with a parent or guardian’s permission and involvement. Accounts with a birthday under 13, accounts with no birthday saved, and accounts a moderator has flagged as possibly under 13 get stricter limits that stay on: phrase-only chat, no public posts, no photo, video or voice uploads, no going live, a display name from a list, a private profile and no friend requests. A parent PIN does not remove those limits. These limits are described on the Kids safety and parents page.
- Children’s privacy. Kemy is designed to collect as little as possible from children: it does not ask for a real name, street address, school, contacts or GPS location. Kemy does not hold a kids-privacy certification or safe-harbor seal. If you are a parent or guardian and believe your child under 13 gave us personal information without your permission, contact us through Message the Kemy team, or have the account deleted with Delete my account and data, and we will delete the information we can, as described in the Privacy Policy.
- Not allowed. You may not use Kemy if we have previously removed or permanently suspended your account, or if using it would break the law where you live.
3. Your account and security
- You can sign up with an email and password or with Google sign-in. Sign-in is handled by Google Firebase Authentication.
- Give accurate information, including your birthday, and keep it up to date.
- Keep your password private and don’t share your account. You are responsible for everything that happens on your account. Tell us right away through Message the Kemy team if you think someone else has used it.
- Don’t pretend to be someone else, including Lone Keem Studios, the Kemy team, a moderator or another player.
- One person, one account. Don’t create, buy, sell or trade accounts, and don’t make new accounts to get around a block, a suspension or a removal.
- Your @username must follow the Community Guidelines. We may change or reclaim a username that breaks them, impersonates someone, or is not being used.
- You can delete your account at any time with Delete my account and data in Settings or Edit profile. Deleting is permanent and can’t be undone. The Privacy Policy explains what is removed, what can remain, and how to ask for uploaded media files to be erased.
4. Your content
“Your content” means anything you post, upload, stream or send on the Service, such as videos, photos, text posts, captions, comments, stories, movies, songs, lyrics, cover art, live streams, chat, your profile and your Pal’s name.
- You keep ownership. Lone Keem Studios does not claim ownership of your content.
- The license you give us. By posting or uploading content, you give Lone Keem Studios a worldwide, non-exclusive, royalty-free, transferable license (with the right to sublicense to the service providers that help us run Kemy) to host, store, copy, process, display, perform, distribute, publish, translate, and adapt your content (for example, to resize, compress, crop, add a thumbnail, caption or age badge, or format it for different screens) for the purpose of operating, providing, improving and promoting the Service. “Promoting” includes showing your public posts in feeds, Explore, search, the home page and in posts or previews that share Kemy, always credited to your @username where practical.
- How long the license lasts. The license ends when you delete the content or your account, except: (a) for copies others have already shared or saved within the Service, (b) for backups and copies kept for a reasonable time for safety, legal or technical reasons, and (c) for media files on our media host that have not yet been erased (see the Privacy Policy).
- Your promises. You promise that (a) you made the content or have all the rights, licenses and permissions needed to post it and to give us the license above, (b) it doesn’t break anyone’s copyright, trademark, privacy, publicity or other rights, (c) anyone who appears in it agreed to be in it (and, for anyone under 18, their parent or guardian agreed too), and (d) it follows these Terms and the Community Guidelines.
- Public by nature. Public posts, comments, live streams and chat can be seen by other people, who may screenshot or remember them. Think before you share, and never post personal information such as your address, school, phone number or passwords.
- Uploads. Uploaded videos can be up to about 10 minutes and 100 MB, and photos up to about 10 MB. Uploaded files are stored with our media host, Cloudinary.
- AI-made work. Community movies and songs are labeled AI-made. If you use AI tools, you are responsible for following those tools’ terms and for making sure the result doesn’t copy someone else’s work, characters, voice or likeness.
- No duty to keep your content. Kemy is not a backup service. Keep your own copies of anything important.
5. Creator age ratings
When you post, you can choose who sees it: All ages (the default), 13+ only, or 17+ only. Community movies also carry their own rating (All ages, 13+, 16+ or 18+).
- You are responsible for rating your content correctly. Choose the rating that honestly fits what is in your post. If you aren’t sure, choose the higher rating.
- How it works. Viewers whose saved birthday says they are younger than the rating don’t see the post anywhere in Kemy. Signed-out viewers and accounts with no birthday saved must confirm they are 13+ or 17+ first. That confirmation is on the honor system and is remembered on their device. Because ages are self-reported, age ratings reduce the chance that younger players see a post, but they can’t guarantee it.
- The rules still apply. A 13+ or 17+ rating is not permission to break the rules. At every rating, Kemy bans nudity, sexual content, real violence or gore, hate, bullying and harassment, and illegal content. The Community Guidelines explain what fits at 13+ and 17+.
- We may re-rate or remove. Lone Keem Studios and its moderators may change a post’s rating, limit who can see it, or remove it at any time, for example when a rating is wrong or the content breaks the rules. Repeatedly mis-rating posts can lead to strikes, a suspension or removal of your account.
6. What you must not do
You agree not to use the Service to do, try to do, or help anyone else do any of the following:
- Post or share nudity, sexual content, sexual comments, or anything that sexualizes a minor in any way. We report child sexual exploitation to the authorities.
- Groom, lure or pressure anyone, especially a minor: asking for their age, address, school, a picture, whether they are alone, or telling them to keep a secret from a parent.
- Harass, bully, threaten, stalk, shame or intimidate anyone, or encourage self-harm.
- Post hate speech, or attack people based on race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation, age or similar traits.
- Post real violence or gore, terrorism or violent extremism, or content that promotes dangerous activities or illegal drugs, weapons or other illegal goods.
- Share anyone’s private information (doxxing), or post photos or video of people without their permission.
- Post content you don’t have the rights to, including pirated movies, other studios’ clips or trailers, other artists’ songs, or Lone Keem Studios releases.
- Spam, scam, phish, run fake giveaways, or post misleading links, chain messages or ads.
- Ask for or offer money, gifts, accounts, Star Coins or Diamonds in exchange for anything outside the app’s own features, or try to sell or trade accounts or virtual items for real money.
- Invite players to other apps or private chats, or share links, phone numbers or emails in chat.
- Impersonate anyone, or misrepresent who you are or your age.
- Cheat, exploit bugs or glitches, use bots, scripts, macros or modified clients, or manipulate games, leaderboards, stars, views, follows or wallets.
- Hack, probe, scan or test the security of the Service; get around security rules, age limits, safety filters, blocks or bans; or access accounts, data or admin and moderator tools that aren’t yours.
- Overload, disrupt or damage the Service, or upload viruses or harmful code.
- Scrape, copy or collect data from the Service or other players by automated means, or use content from Kemy to train AI models, without our written permission.
- Make false reports, abuse the Report button, or harass moderators.
- Break any law or regulation, or encourage anyone else to.
7. Moderation, removal, suspension and termination
- How we moderate. Kemy uses on-device safety checks, word and phrase filters, a moderation panel that receives reports, human moderators chosen by the studio, and an automated helper. Posts may be held for review before they appear. No system catches everything.
- Block and Report. You can Block and Report players, chat lines, posts, comments and profiles. Reports go to the moderation panel.
- Our rights. Lone Keem Studios may, at its sole discretion and at any time, with or without notice or a reason, review, hold, hide, re-rate, limit, or remove any content; issue warnings or strikes; pause features such as posting, commenting, chat or reporting; suspend an account for a set time or permanently; mark an account as possibly under 13; or terminate an account and your access to the Service. We usually act because something broke these Terms or the Community Guidelines, but we may also act to protect players, Kemy, or the public, or to follow the law.
- We are not required to monitor. We try to keep Kemy safe, but we don’t promise to review everything, and we are not responsible for content we didn’t create.
- No liability for moderation. To the fullest extent allowed by law, Lone Keem Studios is not liable to you or anyone else for removing or not removing content, or for suspending or not suspending an account, or for any loss of content, Star Coins, Diamonds, Pals, houses or other items that results.
- Appeals. If you think we made a mistake, reply to the moderation notice or use Message the Kemy team. We will look, but the final decision is ours.
- If you leave or are removed. You can stop using Kemy at any time and delete your account. If your account is terminated, your right to use the Service ends right away, and Star Coins, Diamonds and other virtual items on it are lost. Sections that by their nature should continue (such as the content license for already-shared copies, virtual items, disclaimers, limitation of liability, indemnification, the arbitration agreement, and governing law) keep applying after your account ends.
- Reporting to authorities. We may keep information and share it with law enforcement when we believe in good faith that the law requires it or that someone may be in danger, as described in the Privacy Policy.
8. Copyright and DMCA
We respect creators’ rights and expect you to do the same. Lone Keem Studios responds to notices of claimed copyright infringement under the U.S. Digital Millennium Copyright Act (DMCA).
Sending a copyright notice
If you believe content on Kemy infringes a copyright you own or are authorized to act for, send a notice through Message the Kemy team (choose Feedback and start your note with “Copyright notice”). Only the studio owner reads those notes. You can also use Report on the post. Your notice must include:
- Your physical or electronic signature (typing your full legal name is fine).
- A description of the copyrighted work you say is being infringed.
- The link to, or a clear description of, the content on Kemy you want removed, so we can find it.
- Your contact information, such as your name, address, phone number and email.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.
We may remove or disable the content and let the person who posted it know, including by sharing a copy of the notice. Sending a false notice can make you liable for damages.
Sending a counter-notice
If your content was removed because of a copyright notice and you believe it was a mistake or misidentification, you can send a counter-notice through Message the Kemy team (start your note with “Copyright counter-notice”). It must include:
- Your physical or electronic signature.
- A description of the content that was removed and where it appeared before it was removed.
- A statement, under penalty of perjury, that you have a good-faith belief the content was removed or disabled as a result of mistake or misidentification.
- Your name, address and phone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is (or, if your address is outside the United States, any judicial district in which Lone Keem Studios may be found), and that you will accept service of process from the person who sent the original notice or their agent.
If we receive a valid counter-notice, we may send a copy to the person who sent the original notice. If they don’t tell us within 10 business days that they have filed a court action to keep the content down, we may restore it in 10 to 14 business days after we received the counter-notice.
Repeat infringers
We keep track of copyright notices. We will, in appropriate circumstances, suspend or permanently terminate the accounts of players who repeatedly infringe copyrights or are the subject of repeated valid notices. We may also remove content that we believe infringes, even without a notice.
9. Kemy’s own content
Kemy, the Kemy name and logo, Kemy the axolotl, Kemy Pals, the app’s design, code, games, art, sounds and music, and the movies, series, songs, lyrics and music videos made by Lone Keem Studios belong to Lone Keem Studios or its licensors and are protected by law. We give you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial fun, as these Terms allow. Please don’t download, copy, re-upload, sell or make your own versions of studio content or the app, except as the Service’s built-in features allow (for example, sharing a link). All rights we don’t expressly give you are reserved.
10. Star Coins, Diamonds and other virtual items
- Kemy has free in-app points (Star Coins and Diamonds) and virtual items (such as Pals, outfits, decor, houses, cars, weapons in games and other items). You earn them by playing, caring for your Pal, daily bonuses, games and other in-app activities.
- No real-money purchases today. You can’t buy Star Coins, Diamonds or items with real money in Kemy right now. The in-app shop may show coin and Diamond packs marked “Coming soon”. If paid packs are ever turned on, they would be sold through Google Play billing in the Android app or a card checkout on the web, and these Terms will be updated before that happens.
- No cash value. Star Coins, Diamonds and virtual items have no cash or real-world value. They are not money, they are not your property, and they can’t be exchanged, redeemed or cashed out for money, goods or services outside Kemy. You get only a limited, revocable license to use them inside the Service.
- No transfers or sales. You may not sell, buy, trade, gift or transfer virtual items, points or accounts outside the features Kemy provides. Any in-app trade-in Kemy offers (for example, selling a Kemy Street house back for Star Coins or Diamonds) happens only at the rate the app shows.
- No refunds. Points and virtual items are not refundable, including when an account is suspended, terminated or deleted, or when a feature changes or ends.
- They can change or expire. We may change prices, earning rates, caps, balances and items, fix balances that were changed by a bug, cheat or exploit, or remove, change or expire points and items at any time, with or without notice, and without liability to you.
11. Third-party services and links
Kemy relies on, links to, or embeds services run by other companies. Those services have their own terms and privacy policies, and your use of them is between you and them. They include:
- Google Firebase (Google) for sign-in, the database, cloud functions and notifications.
- Cloudinary for storing and delivering photos, videos and audio.
- YouTube (Google) for big live streams and for YouTube videos shown in Kemy. YouTube’s Terms of Service apply to those.
- Google Play for the Kemy Android app. Google Play’s terms also apply to your download and use of the app. Google is not a party to these Terms and is not responsible for Kemy.
- GitHub Pages for hosting the website, GIPHY for GIFs, Pollinations.AI for Talk to your Pal replies, and news outlets whose headlines open on their own websites.
We don’t control and aren’t responsible for third-party services, websites, links, content, availability or practices, and a link is not an endorsement. If a third-party service changes or stops, a Kemy feature that depends on it may change or stop too.
12. Other players, interactions and meetups
- You are solely responsible for how you interact with other players. Lone Keem Studios does not screen players, check identities or verify ages, and is not responsible for what other players say, post or do, on or off Kemy.
- Never meet anyone from Kemy in person. Kemy is not for arranging in-person meetups, and you agree not to use it to arrange one. Don’t share your address, school, phone number, other social accounts or pictures of yourself with people you meet on Kemy.
- Private player-to-player messages are turned off. Public chat is filtered, and anyone can Block or Report.
- If someone makes you feel unsafe, Block and Report them, tell a trusted adult, and if anyone is in immediate danger, contact your local emergency services.
- Disputes between players are between those players. We may help, but we don’t have to.
13. Live streams
- Live streams follow these Terms and the Community Guidelines, including live chat and the stars people send. You must be 13 or older to go live, and only show things you have the right to show.
- Regular Kemy lives are sent peer-to-peer from the host to viewers and are not recorded by Kemy, but people watching can see, screenshot or record what you share.
- Big lives run through YouTube Live and must be from your own YouTube channel. A YouTube live is public on YouTube (or unlisted, if you choose), YouTube may record and keep it, and YouTube’s own terms and community guidelines apply.
- Lone Keem Studios and its moderators may end any live, remove its chat, or limit who can go live, at any time.
14. Feedback and ideas
We love hearing ideas. If you send us feedback, suggestions or bug reports, you agree that Lone Keem Studios may use them in any way, without paying you or crediting you and without any obligation to you, and you won’t claim any rights in features built from them. Please don’t send ideas you want to keep private or be paid for.
15. AI features
Some features use AI, such as Talk to your Pal, the movie maker, and AI-made community movies and songs. AI output can be wrong, strange or unexpected. It is for fun only and is not advice. Don’t share personal information with your Pal, and don’t rely on AI output for anything important.
16. Changes to the Service
Kemy is a small, independent studio project. We may add, change, pause or remove any feature, game, item or content, limit how much you can use, or stop the Service entirely, at any time, with or without notice, and without liability to you. The Service may sometimes be slow, unavailable or have bugs.
17. Disclaimers
THE SERVICE, AND ALL CONTENT, FEATURES, GAMES, VIRTUAL ITEMS AND AI OUTPUT IN IT, ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT ALLOWED BY LAW, LONE KEEM STUDIOS DISCLAIMS ALL WARRANTIES, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE. WE DO NOT PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES; THAT CONTENT WILL BE ACCURATE, APPROPRIATE OR KEPT; THAT SAFETY FILTERS, AGE RATINGS OR AGE LIMITS WILL CATCH EVERYTHING; OR THAT DEFECTS WILL BE FIXED. YOU USE THE SERVICE AT YOUR OWN RISK.
WE ARE NOT RESPONSIBLE FOR CONTENT POSTED BY PLAYERS OR THIRD PARTIES, OR FOR THE CONDUCT OF ANY PLAYER, ON OR OFF THE SERVICE. Some places don’t allow certain warranties to be disclaimed, so some of these disclaimers may not apply to you.
18. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, LONE KEEM STUDIOS, ITS OWNER, AND ITS MODERATORS, HELPERS, LICENSORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, CONTENT, GOODWILL, STAR COINS, DIAMONDS OR VIRTUAL ITEMS, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR ANY OTHER LEGAL THEORY, AND EVEN IF WE WERE TOLD THEY WERE POSSIBLE.
TO THE FULLEST EXTENT ALLOWED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID LONE KEEM STUDIOS FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE (FOR KEMY’S FREE SERVICE, THAT IS $0), OR (B) FIFTY U.S. DOLLARS (US $50).
These limits apply even if a remedy fails of its essential purpose. Some places don’t allow certain limits on liability, so some of these limits may not apply to you. Nothing in these Terms limits liability that can’t be limited by law.
19. Indemnification
To the fullest extent allowed by law, you agree to defend, indemnify and hold harmless Lone Keem Studios, its owner, and its moderators, helpers, licensors and service providers from and against any claims, demands, losses, damages, liabilities, costs and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your content, (b) your use or misuse of the Service, (c) your breaking these Terms or the Community Guidelines, (d) your violating any law or anyone else’s rights, or (e) your interactions with other players. We may take control of the defense of any such claim, and you agree to cooperate with us. If you are a minor, your parent or guardian agrees to this on your behalf.
20. Disputes and binding arbitration
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court, to have a jury trial, and to join a class action.
Try to work it out first
Most problems can be fixed quickly. Before starting arbitration or a small-claims case, you agree to first send us a written description of the problem and what you want through Message the Kemy team (start your note with “Dispute”), including your @username and how to reach you, and we will do the same to you through the app or the contact details on your account. Both sides agree to try in good faith to resolve it informally for at least 60 days after the notice is received.
Agreement to arbitrate
If we can’t resolve it, you and Lone Keem Studios agree that any dispute, claim or controversy arising out of or relating to these Terms or the Service (including questions about whether this arbitration agreement applies, is enforceable or covers a dispute) will be resolved by final and binding individual arbitration, rather than in court, except as described under “Exceptions” below. This arbitration agreement is governed by the U.S. Federal Arbitration Act.
Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules in effect when the arbitration starts, before a single neutral arbitrator. If the AAA is unavailable, the parties will agree on another arbitration provider or ask a court to choose one. The arbitration will be seated in the State of Maine. Hearings will be held by video or phone, or based only on written submissions, unless the arbitrator decides an in-person hearing is needed, in which case it will be held in Maine or in the county where you live, whichever you choose. The arbitrator may award the same individual relief a court could award, but only to the individual party seeking relief and only as needed for that party’s individual claim. Payment of arbitration fees will follow the AAA’s consumer fee rules. The arbitrator’s decision is final, and judgment on it may be entered in any court with jurisdiction.
Class action waiver
YOU AND LONE KEEM STUDIOS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE ACTION OR PROCEEDING. The arbitrator may not consolidate more than one person’s claims or preside over any form of class or representative proceeding. If this class action waiver is found unenforceable for a particular claim, then that claim (and only that claim) must be severed and brought in court as described in “Governing law and venue”, and not in arbitration.
Jury trial waiver
YOU AND LONE KEEM STUDIOS EACH WAIVE ANY RIGHT TO A JURY TRIAL for any dispute arising out of or relating to these Terms or the Service, whether in arbitration or, where arbitration doesn’t apply, in court.
Exceptions
- Small claims. Either side may bring an individual claim in small-claims court instead, as long as it qualifies and stays there on an individual basis.
- Intellectual property and misuse. Either side may go to court to stop infringement or misuse of copyrights, trademarks, trade secrets or other intellectual property, or to stop hacking, scraping or other unauthorized access to the Service.
30-day right to opt out
You can opt out of this arbitration agreement by sending us a note through Message the Kemy team within 30 days after you first agree to these Terms. Start the note with “Arbitration opt-out” and include your @username and a clear statement that you want to opt out of arbitration. Opting out won’t affect any other part of these Terms. If you opt out, disputes will be resolved in court as described in “Governing law and venue”, and the jury trial waiver above will still apply to the extent allowed by law.
Changes to this section
If we make a material change to this arbitration section, the change won’t apply to a dispute that you or we gave notice of before the change. You can reject a material change to this section within 30 days after it takes effect by sending a note as described in the opt-out above, and then the arbitration section in the version you last accepted will continue to apply.
Time limit
To the extent allowed by law, any claim must be started within one year after it arose, or it is permanently barred.
21. Governing law and venue
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Maine, United States, without regard to its conflict-of-law rules, except that the arbitration agreement above is governed by the Federal Arbitration Act. For any dispute that is not subject to arbitration (including claims brought by players who opted out, claims that must be severed under the class action waiver, and the exceptions above other than small claims), you and Lone Keem Studios agree to the exclusive jurisdiction and venue of the state and federal courts located in the State of Maine, and waive any objection to those courts based on inconvenience or venue. The United Nations Convention on Contracts for the International Sale of Goods does not apply. If you live outside the United States, you may also have rights under the laws of the place where you live that can’t be waived by contract, and nothing here takes those away.
22. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the “Last updated” date at the top of this page, and for important changes we may also let you know in the app, for example in What’s New or a notice. Changes apply from the date they are posted, except as described in the arbitration section. If you keep using the Service after a change, you accept the new Terms. If you don’t agree to them, stop using the Service and delete your account.
23. General terms
- Entire agreement. These Terms, together with the Community Guidelines, the Community Rules, the Privacy Policy and any feature rules mentioned above, are the entire agreement between you and Lone Keem Studios about the Service, and replace any earlier versions or understandings.
- Severability. If any part of these Terms is found invalid or unenforceable, that part will be limited or removed only as much as needed, and the rest stays in full effect (except as stated in the class action waiver).
- No waiver. If we don’t enforce a part of these Terms right away, that doesn’t mean we give up our right to enforce it later.
- Assignment. You may not transfer these Terms or your account to anyone else. Lone Keem Studios may transfer these Terms, in whole or part, including in connection with a sale, merger or reorganization, or to a successor that continues the Service.
- Force majeure. We are not responsible for delays or failures caused by things beyond our reasonable control, such as outages or changes at our service providers (including Google, Firebase, Cloudinary, YouTube, GitHub or Google Play), internet or power failures, natural disasters, illness, war, government action, or attacks on the Service.
- No third-party beneficiaries. These Terms don’t give anyone else any rights, except for the people protected by the limitation of liability and indemnification sections.
- Relationship. Nothing in these Terms makes you and Lone Keem Studios partners, employees, agents or joint venturers.
- Notices. We may give you notices in the app, by notification, or by email to the address on your account. You give notices to us through Message the Kemy team.
- Headings and language. Headings and the short version at the top are for convenience only. “Including” means “including without limitation”. If these Terms are translated, the English version controls.
- Export and sanctions. You may not use the Service if doing so would violate U.S. export or sanctions laws.
24. Contact
Questions, problems, copyright notices, disputes or opt-outs? Sign in and use Message the Kemy team in Settings or Help. Only the studio owner reads those notes. You can also use Report or Block on a player, a chat line, a post, or a comment. There is no public email address on this page.
